Terms & Conditions

Unauthorized use of this website and our systems, including but not limited to unauthorized entry into our systems, misuse of passwords, or misuse of any information on the website is prohibited.
 

Responsibility for Sales and Artwork

The Fine Arts Society of Milton is a not-for-profit organization comprised of Artists who create works of art using a variety of media. We connect Artists and Buyers through this platform and provide the opportunity for the public to purchase pieces of art for personal enjoyment. This website is owned and operated by The Fine Arts Society of Milton.

 

As The Fine Arts Society of Milton does not sell works of art directly to Buyers (other than those identified as FASM products), all purchase arrangements must be made between Artists and Buyers.
 

Prices

Prices for products may change periodically. However, orders placed before changes are implemented will not be impacted so long as an Order Confirmation email is issued to the Buyer before changes become effective.

 

The price of a product excludes delivery charges. Delivery or pickup arrangements must be made directly with the Artist, and Buyers are advised to contact Artists directly for delivery options and fee information prior to purchase. Fees associated with delivery must be paid directly to the Artist. There is a cancellation charge of 5% once an Order Confirmation email is issued.

 

It is advisable to confirm all fee details with the Artist prior to making a purchase.
 

Product Descriptions

Details of products are provided by Artists. The Fine Arts Society of Milton does not warrant any product description to be 100% accurate, complete, reliable, current, or error-free. 

 

The images of the products on our website are for illustrative purposes only. Products may vary slightly from images as depicted on this website and the depiction of products with accessories (e.g. frames) may be used for illustrative purposes only.  Before placing an order, please verify with the Artist who is featuring the product you would like to purchase that displayed accessories are included in the purchase price.

 

If additional information is required, please contact the Artist directly using the contact information listed for the specific Artist on the Our Artists page (https://www.fasmgallery.com/our-artists).  If there are any questions outside of this, please use the Support link on the website to speak with the website Administrator.
 

Delivery

Artists aim to ship products within 7 days from the date of accepting your order. Notice of unexpected delays will be sent by email.  Artists and The Fine Arts Society of Milton are not responsible for any loss (including but not limited to the cost of any replacement purchase) that may occur due to delivery timing or availability of products.

 

Buyers are responsible for ensuring delivery information is accurate when communicating with the Artist. Buyers are also responsible for making delivery arrangements to receive artwork. While Artists will make every effort to work with Buyers to arrange timely delivery of products, it is the Buyer’s responsibility to ensure receipt of product at the location and time that the Buyer specifies. Where delivery has been attempted as arranged but has not been successful due to the Buyer’s actions, any additional delivery charges incurred will be borne by the Buyer.

 

Upon receipt of your order, carefully examine both the package (before it is opened) and the product for any damage. If there is damage or if a package shows signs of damage before it is opened, we highly recommend that you sign the parcel receipt, 'Received Damaged'.  If a product is damaged, please email the Artist or contact The Fine Arts Society of Milton at fasminfo@gmail.com.
 

Limitation of Liability and Indemnity

The Artist and The Fine Arts Society of Milton are not responsible for direct, special, incidental or consequential damages resulting from any breach of warranty or under any legal theory.  These terms and conditions also limits our liability for death or personal injury resulting from our negligence or that of our artists or agents. 

 

The Artist and The Fine Arts Society of Milton will never be liable for any indirect, incidental or consequential loss or damage, including any economic loss or loss of profit or business whatsoever suffered by the Buyer or any third party
 

In the event of a perceived breach of any of these Terms and Conditions, recourse is limited to damages which in no circumstance whatsoever will exceed the price of the product.
 

The Buyer will indemnify the Artist and The Fine Arts Society of Milton against all claims, costs and expenses which we may incur and which may arise, directly or indirectly, from the Buyer’s breach of any of its obligations under these Terms and Conditions.

 

We may revise these Terms from time to time in the following circumstances: a) changes in how we accept payment from you; b) changes in how we conduct business; or c) changes in relevant laws and regulatory requirements.
